Teaching in the second term.

Going to courts is the classic way of resolving disputes. The course - Arbitration and alternative dispute resolution - deals with the alternative ways which are developing every day. First it will be necessary to define them and make the necessary distinctions (arbitration, negotiation, mediation, conciliation, mini-trial, etc.). It is then possible to study their legal regime. Particular attention will be paid to the arbitration procedure.

In addition, specific subjects related to arbitration will be discussed. For example, topics such as the ecological transition in investment arbitration, sports arbitration or the 2024 reform of the Judicial Code could be discussed.

Learning outcomes of the learning unit

The purpose of the course is to enable the students to determine, in consideration of the circumstances of a case, what is the best way to resolve a dispute. The main focus will be on arbitration.           

Prerequisite knowledge and skills

Planned learning activities and teaching methods

Ex cathedra courses combined with discussions in class. Students will be asked to prepare some specific topics beforehand to discuss them in class. Procedural acts can also be analyzed.

Possible participation to "Willem C. Vis International Commercial Arbitration Moot" in Vienna.
