The course is wide in scope as it examines the rules applicable to minors in general. It covers the statute of the child being a member of his/her family, the specific statute of the juvenile delinquent, the consequences for the child when his/her parents are getting divorced, the adoption and the consequences of civil liability for the child and its parents as well. A very important part of the course relates to what assistance and measures may be given or taken in order to help the child and his/her family facing difficulties (eg. mistreatment).

For years, the title of this course has been "Protection de la jeunesse". However, it has to be changed because the legislation is now very different than it was in 1965: the children have been granted more rights including during judicial proceedings. Of course the most important aim of the law remains to protect the young's but this area of the law has mutated, increasing the number of legislating authorities and people involved in this field, who are supposed to manage this very specific area of law.

The course incorporates the recent reform adopted on 18/01/2018. The students will be invited to read one ou two books on the topic "The child's interest". The students will be also challenged on the content of these books. 

Learning outcomes of the learning unit

The goal of the course is to outline the principles of the federal legislation (child protection) and the regional legislation, the influence of international law (especially the case law of the European Court of Human Rights and the Convention on the Rights of the Child).

Written examination in January or oral examination in June, at the option of the student.
Students who wish to sit the written examination in January must register by sending an email  in December by the deadline set by the student services. Students must register for an oral examination date in June through the student services. Students should have a precise knowledge of the substance of the written course materials and be able to apply it to a case. Students may bring legislation into the examination. The following instructions must be respected with respect to annotating the codes and legislation:
Permitted:
- table of contents of the collection of legislation or the code;
- annotations with the Articles (Article references);
- margin references with a single key-word;
- colours, underlining, highlighting, etc.:
- post-it notes with titles, chapters or sections that appear in the table of contents.
Not permitted:
- annotations with two or more keywords;
- tables by keywords or a table of personal materials;
- post-it notes with keywords;
- any other annotation that the Professor would consider excessive.
