Learning unit contents
The ventôse decree, organic for notaries, is the core of the notary's work. This decree is the very foundation of the notarial profession, that is, of the notary's functions and status, and for the governing rules.
We therefore thought it was logical to structure this course following the order of the articles in the decree. This method has its limits but will allow the student to understand profoundly the founding texts of the profession.
Using this working basis as a starting point, we will move towards many other sources in the subject.
Learning outcomes of the learning unit
The objective is to arrive at the point where knowledge and reasoning are firmly established at the end of the course. A notary must develop legal reflexes that are based on well-honed knowledge. In short, the notary must be competent. To be competent, the notary must know "the ABCs" of the matter and know how to use it.
It is also crucial to work towards a preventive philosophy, essential when practising the profession of notary. There is a need to:
- develop legal reflexes ("think about what is necessary")
and
- have a comprehensive view of things ("think of everything").
This is what will allow the notary to take good decisions and give good advice to his or her clients.
Using the Codes and regulations will be crucial.
The students are also expected to make efficient use of the E-Notariat mainly to find useful sources for the course.
Prerequisite knowledge and skills
The course will be based on the usual knowledge that may be expected of someone who holds a Master's in law.
One of the features of the material is that it contains many specific rules. The students are not expected to know everything "by heart" but rather to understand how these rules focus on each other and learn how to find answers to many questions that are raised in the matter.
Planned learning activities and teaching methods
The teaching will be chiefly structured around lectures given by the teacher who will in particular ask students to share questions of an ethical nature in particular and of notarial practice in general, questions with which they could be confronted during their work placement.

Recommended or required readings
The teacher will make course notes on certain aspects of the course available to the students.
The students are invited to consult and actively use applicable legislation and regulations.
Students are also asked to keep up to date as regards legal developments in the field which often evolves.

Additional information:
The assessment will take the form of an oral examination - an interview of about 20 minutes with the teacher and based on questions asked the students. The students will have about 20 minutes to prepare their answers.
During the oral exam, different questions will be asked regarding what have been learnt.
The use of Codes, legal texts and regulations is indispensable for the exam. Underlining, highlighting and post-its are allowed, but notes are forbidden throughout.
The same rules apply to any second sessions.
